Terms of Service

Effective date: 7th of June, 2023

THESE TERMS OF SERVICE (the "Agreement") GOVERN YOUR ACCESS TO AND USE OF THE SKLAUNCHER MINECRAFT LAUNCHER SERVICE (the "Service") PROVIDED BY SKLAUNCHER ("SKlauncher"). BY (A) ACCESSING THE SERVICE THROUGH AN ONLINE PROCESS THAT REFERENCES THIS AGREEMENT, (B) SIGNING UP FOR THE SERVICE THROUGH A SCREEN THAT REFERENCES THIS AGREEMENT, OR (C) CLICKING A BOX INDICATING ACCEPTANCE, YOU AGREE TO BE BOUND BY THESE TERMS.

THE INDIVIDUAL ACCEPTING THIS AGREEMENT DOES SO ON THEIR OWN BEHALF AND REPRESENTS THAT THEY AGREE WITH THESE TERMS AND CONDITIONS. IF THE INDIVIDUAL DOES NOT AGREE WITH THESE TERMS AND CONDITIONS, SUCH INDIVIDUAL MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICE. CAPITALIZED TERMS HAVE THE DEFINITIONS SET FORTH HEREIN. THE PARTIES AGREE AS FOLLOWS:

1. The Service

1.1. Service Description. SKlauncher is the provider of a free, independent Minecraft launcher service ("Service"). Anything users post, upload, share, store, or otherwise provide through the Service is considered a "User Submission." Users are solely responsible for all User Submissions they contribute to the Service.

1.2. Relationship to Mojang. This Service is not affiliated with Mojang AB, the developers of Minecraft, and does not represent them in any capacity.

1.3. No Fee for Use or Redistribution. SKlauncher does not charge any fee for the use or redistribution of the Service.

2. Liability

2.1. User Responsibility. Use of the Service is at the user's own risk. While SKlauncher prides itself on the long-standing and unblemished reputation of its software's safety, which can be verified on various antivirus report websites, it cannot guarantee the safety of any additional modifications ("mods") that users may download for use in the game. Users are solely responsible for any damage to their computer system or loss of data that results from the download or use of such mods. However, the SKlauncher software itself is designed to be safe and reliable, and SKlauncher disclaims all liability for any harm that may occur as a result of using the Service.

3. User Obligations

3.1. Compliance with Laws. Users shall comply with all local, state, national, and international laws, rules, and regulations applicable to their use of the Service.

3.2. Prohibited Activities. Users shall not engage in any illegal activities in connection with the Service, including but not limited to hacking, phishing, or distribution of malicious software.

4. Intellectual Property

4.1. Ownership of Service. The Service is owned and operated by SKlauncher. All rights, titles, and interests in and to the Service, including all intellectual property rights therein, are and will remain with SKlauncher.

4.2. User Submissions. Users retain all ownership rights in and to their User Submissions. By posting, uploading, or otherwise providing a User Submission to the Service, the user grants SKlauncher a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Service and SKlauncher's business.

5. Privacy

5.1. Personal Information. SKlauncher's use of personal information provided by users is governed by SKlauncher's Privacy Policy, which is incorporated into this Agreement by reference.

6. Termination

6.1. Termination by SKlauncher. SKlauncher may terminate this Agreement and a user's access to the Service at any time, for any reason or no reason, with or without notice.

6.2. While SKlauncher currently allows access to all Minecraft users, both offline and premium, this may be subject to change in the future based on various factors, including but not limited to changes in the terms of service, changes in laws and regulations, or changes in the relationship between SKlauncher and other parties.

7. Disclaimer of Warranties

7.1. The Service is provided "as is" and on an "as available" basis, without any warranties of any kind to the fullest extent permitted by law, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

8.1. In no event will SKlauncher be liable to users or any third party for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to this Agreement or a user's use or inability to use the Service.

By using the Service, you agree to abide by these terms. If you do not agree to these terms, you may not use the Service.
